Chicago DUI lawyer comments on Chicago Police Officer's narrow avoidance of a Chicago DUI

Yesterday the trial began against off-duty Chicago Police Officer Abbate.  He is accused of aggravated battery and official miscondunct for allegedly beating a bartender in a local bar who refused to serve him any more alcohol.

The trial is getting under way for a veteran Chicago police officer allegedly captured on videotape beating a bartender after she refused to serve him more drinks.

Video footage from a tavern security camera shows a man thought to be Abbate punching, kicking and throwing a bartender half his size to the floor.
I am curious as to how Officer Abbate got home that night.  It appears he was arrested at his home.  Additionally, he does have a prior DUI arrest from 1992.  He received court supervision and the charge was subsequently dismissed. I can't imagine any "professional courtesies" were given to him in this instance.
