Chicago DUI lawyer warns: Chicago DUI arrest can cause the government to take your car

It should not come as a surprise, since Illinois law does permit the forfeiture of cars used in the commission of crime ( including DUI arrests), but some counties are seizing the day! I mentioned here and here that you should be aware that the government can take your car just because you were charged with a DUI. Since this is a civil proceeding, the taking of the vehicle (yes I mean owning it) can be completed before an individual has pled or been found guilty of a DUI.

Last month, prosecutors in Madison County filed five vehicle-forfeiture cases. Each involved a driver charged with felony drunken driving or with a history drunken driving who were charged with driving with a revoked license. 


The vehicles sought by prosecutors are: a 2006 Corvette, a 1985 Corvette, a 1998 
FordWindstar, a 1996 Cadillac Deville and a 1993 Chevrolet Silverado. 


Is anyone else surprised that the cars being taken by the government are not too shabby?
