Chicago DUI lawyer thinks the Illinois State Police is wrong on Illinois Medical Marijuana legislation

 In Illinois,you  are not permitted to operate a vehicle (legally) with any amount of weed in your body.  I previously discussed the perils of celebrating the 420 Highliday while driving and a general discussion of the law as it relates to Chicago DUI's and weed. That law is about to run smack dab into a growing movement to legalize the use of marijuana in Illinois for medical purposes.

More than 60 religious leaders in Illinois are calling on state senators this week to pass a bill that would allow patients to use medical marijuana with a doctor's recommendation and without criminal consequences. "Medical marijuana is an issue of mercy and compassion," said Rev. Bill Pyatt of the First United Methodist Church of Carthage. "We pray that the Illinois legislature will have the compassion to stop this war on patients."

Several studies suggest that marijuana can mitigate nausea, pain and anxiety for patients with illnesses such as HIV, cancer, multiple sclerosis and chronic pain. Theological arguments are based on these findings. 

Illinois State Police oppose the bill, saying there is no way to measure impairment for enforcement of DUI laws, and calling marijuana a gateway drug.

I disagree with the Illinois State Police's rationale for opposing the bill.  Currently in Illinois, and yes I posted on this issue before, you can be charged with a Chicago DUI, and found guilty, for use of prescription drugs.  The determination is left to the judge or jury if the prescription drug caused your driving to be impaired.  Somehow I think the Illinois State Police is aware of this so I cannot understand why the same standard would not be used for folks who are legally permitted to use Marijuana for medical purposes, can you?
