Wisconsin is still the only state where a first OWI isn't always a crime.
If there's a minor in the car Brian Barton, Deputy District Attorney for La Crosse County says, "that now becomes a crime instead of a civil forfeiture."
It took 5 OWI's before a drunk driver was charged with a felony, now that number is four.
But, those trying to eliminate drunk driving didn't get everything they were hoping for.
It will still be illegal for officers to set up roadside sobriety checkpoints.
